Müşteri’nin, siparişini getiren kuryeye, İnternet Sitesi üzerinden bahşiş ödemesi yapmak istemesi halinde, siparişi onayla sayfasında yer alan bahşiş tutarlarından birini seçip ya da istediği tutarı girdikten sonra yönlendirileceği ödeme ekranında işlem yapması gerekecektir. Bahşiş Müşteri memnuniyetine bağlıdır ve tamamıyla Müşteri’nin isteği üzerine uygulanır. Bahşiş tutarının tamamı Müşteri’nin bahşiş vermeyi seçtiği kuryeye ödenecektir. Uludağ Et Lokantası bu tutarı sadece bir aracı olarak tahsil etmektedir. 3.6. Müşteri, bahşiş tutarlarından birini seçip ya da istediği tutarı girdikten sonra “Gönder” tuşuna basarak, (i) Kurye’ye belirtilen tutarda bahşiş vermeyi ve (ii) Uludağ Et Lokantası'nın bu tutarı ilgili sipariş verirken Online Ödeme Sistemi üzerinden kullandığı kredi kartı vasıtasıyla tahsil etmesini kabul eder. Bahşiş ödemesi, ilgili siparişte kullanılan kredi kartına ikinci bir işlem olarak yansıyacaktır. Bahşiş ödemesi iptal edilemez; “Gönder” tuşuna basılması ile birlikte Uludağ Et Lokantası tüm bahşiş tutarını tahsil etmiş olacaktır ve sonrasında herhangi bir iade işlemi gerçekleştirilemeyecektir. 3.7. Müşteri, Online Ödeme Sistemi kapsamında kullanılan kredi kartının, kart hamili haricinde, bir başkası tarafından hukuka aykırı şekilde kullanılması halinde 23.02.2006 tarihli 5464 sayılı Banka Kartları ve Kredi Kartları Kanunu ve 10.03.2007 tarihli ve 26458 sayılı Resmi Gazete’de yayımlanan Banka Kartları ve Kredi Kartları Hakkında Yönetmelik hükümlerine göre işlem yapılacağını kabul eder. 3.8. Müşteri’nin İnternet Sitesi’ni kullandığı cihazını kaybetmesi veya cihazın çalınması halinde, 3. Kişiler İnternet Sitesi’nde tanımlı kart bilgilerine erişemez. Müşteri, İnternet Sitesi aracılığıyla Uludağ Et Lokantası tarafından sunulan hizmetlerden yararlanabilmek amacıyla kullandığı sistem erişim araçlarının (kullanıcı ismi, şifre v.b.) güvenliği, saklanması, üçüncü kişilerin bilgisinden uzak tutulması ile ilgili tüm sorumluluğun tamamen kendisine ait olduğunu kabul eder. Bu nedenle, Müşteri’nin Ürün’ü geç teslim almasından kaynaklanan her türlü zarar ile Ürün’ün Müşteri’nin kusurundan dolayı beklemiş olması ve/veya Ürün’ün teslim edilememesi nedeniyle Uludağ Et Lokantası'na iade edilmesinden dolayı oluşan giderler de Müşteri’ye aittir. Uludağ Et Lokantası'nın sunduğu hizmetten yararlanan Müşteri, İnternet Sitesini hukuka ve amacına uygun şekilde kullanmayı ve İnternet Sitesi dahilinde yaptığı her işlem ve eylemdeki hukuki sorumluluğunun kendisine ait olduğunu kabul eder. Müşteri’nin İnternet Sitesi aracılığıyla ve/veya dahilinde, Koşullar’a ve hukuka aykırı olarak gerçekleştirdiği herhangi bir işlem, eylem ve/veya faaliyetleri nedeniyle Uludağ Et Lokantası'nı doğrudan veya dolaylı olarak hiçbir şekilde sorumlu tutulamaz. 3.15. Uludağ Et Lokantası, Müşteri’den kaynaklanan teknik aksaklıklar sebebiyle hizmetten faydalanılamaması durumunda yükümlülüklerini ifa edememesi nedeniyle sorumlu tutulamayacak ve kendisinden herhangi bir nam altında herhangi bir talepte bulunulamayacaktır. 3.16. Müşteri, İnternet Sitesi üzerinden verilen tüm siparişlerin kişisel kullanım ve tüketim amaçlı olarak son kullanıcıya yapıldığını, tekrar satış amaçlı olmadığını kabul eder. 3.17. Siparişe ilişkin fiş veya fatura Uludağ Et Lokantası tarafından hazırlanarak sipariş ile birlikte Müşteri’ye teslim edilir. 3.19. Müşteri, Uludağ Et Lokantası'na ait Ürün sipariş ettiğinde, uludagpaket.com sadece bir aracı olarak hareket eder ve bu nedenle Üye İşyeri tarafından sunulan Ürün kalitesinden, doğru sağlanmasından ya da Uludağ Et Lokantası'ndan Müşteri’ye İnternet Sitesi üzerinden sunduğu Ürün nedeniyle vermiş olduğu zararın tazmininden sorumlu olamaz. 3.20. İnternet Sitesi üzerinden verilen siparişlerinde, ücret iadesi ancak; (i) siparişin ilgili restorana iletilememesi veya restoranın aşırı yoğunluk, kurye bulunmaması, elektrik arızası, kaza gibi haller nedeniyle siparişi hazırlayabilecek ya da teslim edebilecek durumda olmaması nedeniyle siparişin zorunlu iptali; (ii) sipariş halen hazırlanmamış iken, Müşteri’nin talebi ve İşyeri’nin kabulü üzerine iptali; (iii) siparişin bir kısmının veya tamamının İşyeri’nde mevcut olmaması nedeniyle siparişin kısmen veya tamamen zorunlu iptali; (iv) sipariş edilen ürünün teslimatının gecikmesi durumunda ilgili İşyeri’nin onayı üzerine iptali; (v) yanlış, hasarlı ya da ayıplı ürün nedeniyle iptali; ya da (vi) memnuniyetsizlik halinde İşyeri’nin onayı üzerine gerçekleştirilecek iptali durumunda yapılacaktır. 3.21. İnternet Sitesi üzerinden verilen yemek siparişlerinde, teslimat İşyeri menüsünün sipariş anındaki mevcudiyetiyle sınırlıdır. Uludağ Et Lokantası, restaurantta bulunmayan ürünlerin Müşteri’ye teslimini sağlayamayabilir. Ürünlerin İnternet Sitesi’nde teşhir edilmesi bunların İşyeri’nin stoğunda bulunduğu anlamına gelmeyebilir. 3.23. İnternet Sitesi üzerinden satışa sunulan İşyeri’ne ait Ürünlerin fiyat veya ürün özelliklerinde hata olması durumunda Uludağ Et Lokantası, Müşteriyi bilgilendirerek, bu hatayı düzeltecek şekilde teslimatı yapabilir veya siparişi iptal edebilir. İnternet Sitesi üzerinden İşyeri’nin satışa sunduğu ürünlerin içeriğine dair doğru ve dürüst açıklama yapılmasına dair Uludağ Et Lokantası gerekli özeni gösterecektir ancak İşyeri’nin sipariş içeriklerine dair yaptıkları eksik ve/veya hatalı açıklamalardan dolayı oluşacak problemlerden veya zararlardan Uludağ Et Lokantası sorumlu olacaktır. 4. Mücbir Sebepler Nakliyeyi engelleyen hava muhalefetleri, ulaşım kesintisi, altyapı ve internet arızaları, yangın, deprem, sel baskını, diğer doğal afetler ile salgın hastalık gibi olağanüstü olayları, kargaşa, yaygın şiddet hareketleri, grev veya resmi makamların düzenlemeleri dahil ancak bunlarla sınırlı olmaksızın yükümlülüklerini yerine getirmesini objektif olarak engelleyebilecek veya geciktirebilecek nitelikteki durumlarda Uludağ Et Lokantası, işbu Koşullar ile belirlenen edimlerinden herhangi birini geç veya eksik ifa etme veya ifa etmeme nedeniyle sorumlu tutulamaz. 9.
